Class Action Litigation

A class action cases involve large numbers of plaintiffs sharing common factual and legal issues and a representative plaintiff providing fair and adequate protection for the class. A class action is a type of lawsuit that permits one or more plaintiffs to file and prosecute a lawsuit on behalf of a larger group or "class". It allows courts to manage lawsuits that would otherwise be unmanageable if each class member (those who have suffered the same wrong due to the defendant) were required to be joined in the lawsuit as a named plaintiff. An example could be a product liability case where numerous plaintiffs are harmed by the same product under the same circumstances. Like product liability cases, given the potential liability in class action cases, defendants try very hard to prevent class action certification, so litigation will be as time consuming and expensive for plaintiffs as possible.

Product Liability

Product liability law involves seeking justice for those injured by a negligently designed, manufactured or marketed product. Examples of these cases can be a defectively designed artificial hip that fails, a forklift that can flip over while lifting a normal load or a medication whose side effects are far more severe than the harm it’s supposed to treat. In these cases, a defendant is liable when the product is demonstrated to be defective. It doesn’t matter if the manufacturer or supplier exercised great care.  If there’s a defect in the product that caused harm, there will be liability. These cases are often driven by highly technical issues such as engineering and medical testing. Given the potential liability, defendants and their insurance companies fight hard against such cases.
